Unified Patent Court Could Become Operational in December 2017

A new update on the Unified Patent Court (UPC) website predicts the Unified Patent Court Agreement (UPCA) will come into effect and the Court become operational as soon as December 2017.

The Preparatory Committee, composed of all the Signatory States to the UPCA, is prepared to start the Provisional Application Phase (PAP) in Spring 2017 and the option to opt out European patents is planned for September. The achievability of this timetable is dependent on numerous factors, the most important being the necessary ratifications of the UPCA – Spain and Poland are still yet to sign.
