USPTO Initiates a Post Prosecution Pilot Program

 

The U.S. Patent and Trademark Office have recently announced the initiation of a new pilot program, known as the Post-Prosecution Pilot (P3) program. The USPTO propose that the new program will enhance patent practice during the period after the final rejection has been issued and before the filing of a notice of appeal or Request for Continued Examination.

Within two months from the mailing date of a final rejection and prior to filing a notice of appeal or RCE, an applicant is able to request for consideration under the P3 and a response to a final rejection. The applicant can then participate in a conference with a panel of examiners to review the response and then receive a written decision from the examiners.
